1. Scope and Controller
Imaginic Productions is the controller of personal information processed through this website, our creator recruitment forms, account portals, contact forms, project workflows, marketing channels, and client service delivery unless a written contract says otherwise.
By accessing our website, submitting any form, applying for creator opportunities, creating or using an account, communicating with us, or engaging our services, you acknowledge that we may process your personal information under this policy, our contracts, platform terms, and applicable law, including Zimbabwe's Cyber and Data Protection Act [Chapter 12:07] where it applies.
If you provide information about another person, you warrant that you have lawful authority to do so and that the person has been informed of this policy.
2. Data We Collect
We collect information that is necessary or useful for legitimate business, platform, legal, security, recruitment, production, marketing, and client service purposes. This may include:
- Identity and contact data, including name, email address, phone number, location, account credentials, user type, and account status.
- Creator profile and recruitment data, including role interests, age or eligibility information where required, gender where voluntarily provided or relevant to casting, images, videos, portfolios, resumes, profile proof files, application answers, project applications, adjudication outcomes, engagement details, salary expectations, availability, and communications.
- Client and project data, including briefs, contracts, brand materials, campaign assets, content, invoices, payment records, feedback, approvals, delivery records, and production files.
- Technical and usage data, including IP address, device and browser information, log files, session data, form submission metadata, upload metadata, security events, cookies, analytics identifiers, and error reports.
- Marketing and communications data, including enquiries, preferences, mailing list interactions, social media messages, call notes, WhatsApp messages, and opt-in or opt-out records.
- Compliance data, including consent records, terms acceptance records, identity checks, fraud prevention data, audit logs, legal notices, dispute records, and records required to defend or enforce rights.
We do not require you to submit special category, highly sensitive, or third-party personal data unless it is reasonably necessary for a specific project, legal obligation, casting requirement, employment or engagement process, safety requirement, or contractual purpose. If you submit unnecessary sensitive data, you do so at your own risk and we may delete, restrict, or retain it as needed to protect the company.
3. How We Use Data
We may process personal information to operate the website and platform, respond to enquiries, administer accounts, review creator applications, manage project calls, approve or decline applications, create and manage engagements, deliver services, communicate with you, process payments, improve our systems, prevent abuse, enforce terms, protect our staff, users, clients, and assets, and comply with legal or regulatory duties.
Where lawful, we may also use contact details, portfolio information, project history, application outcomes, and engagement records to assess future opportunities, contact creators about suitable roles, maintain a defensible audit trail, promote completed work, administer client relationships, and protect our commercial interests.
We rely on one or more lawful grounds, including consent, contract performance, steps taken at your request before entering a contract, compliance with law, legitimate business interests, public or legal claims interests, and any other lawful basis available under applicable law.
5. Security
We use reasonable administrative, technical, and organisational safeguards designed to protect personal information against accidental or unlawful loss, unauthorised access, misuse, alteration, and disclosure. No website, network, device, email account, messaging channel, upload process, or storage system is perfectly secure.
You are responsible for keeping your login details, email account, device, and communications secure. We may suspend, restrict, or terminate access where we suspect misuse, unauthorised access, compromised credentials, fraud, legal risk, or breach of our terms.
6. Retention
We retain personal information for as long as reasonably necessary for the purposes collected, including active services, account administration, recruitment, project delivery, relationship management, accounting, tax, audit, security, legal compliance, dispute handling, enforcement, backup, and business continuity.
We may keep declined, withdrawn, inactive, deleted, or closed account records where retention is necessary to maintain application history, prevent duplicate or abusive submissions, defend decisions, comply with law, resolve disputes, enforce contracts, protect the company, or preserve evidence. Backup copies and system logs may remain until overwritten in the ordinary course of business.
7. Account Deletion Policy
You may request deletion or closure of your account by contacting us through the details below. We may require identity verification, account control verification, additional information, or written confirmation before processing the request.
Account deletion is not an absolute right. To the maximum extent allowed by law, we may refuse, delay, limit, or reverse deletion where information is needed for contracts, active or completed projects, payments, tax, accounting, legal compliance, dispute resolution, safety, fraud prevention, audit logs, security, internal administration, legitimate business records, enforcement of terms, or protection of our rights, staff, clients, users, systems, and commercial interests.
Deleting an account may permanently remove or disable access to profile information, project applications, engagement history, saved documents, portfolio files, messages, uploads, preferences, and platform features. It does not automatically delete records held by clients, production partners, email providers, payment providers, analytics providers, backup systems, legal files, accounting systems, or third parties who received information lawfully before deletion.
Where a deletion request is approved, we may delete, anonymise, restrict, archive, or de-identify the relevant information at our discretion, depending on operational, legal, technical, and evidentiary requirements. We are not responsible for loss of access, missed opportunities, incomplete applications, terminated workflows, or inability to restore data after deletion.
8. Your Rights and Requests
Depending on applicable law, you may have rights to request access, correction, deletion, restriction, objection, portability, withdrawal of consent, or information about processing. These rights are subject to legal limits, identity verification, proportionality, confidentiality, third-party rights, privilege, security, business records, and our lawful grounds for retention.
We may reject repetitive, abusive, fraudulent, technically unreasonable, commercially disproportionate, legally unsupported, or inadequately verified requests. We may charge a lawful administrative fee where permitted, especially for excessive, repeated, or manifestly unfounded requests.
9. Cookies, Analytics, and Third-Party Services
Our website may use cookies, local storage, analytics tools, embedded content, social media links, hosting services, email tools, messaging channels, payment tools, and security services. These services may collect technical data under their own policies. You can control cookies through your browser, but disabling them may break account, form, upload, security, or preference features.
10. Children and Minors
Our website and services are not intended for unsupervised use by children. Where a project, casting, or creator opportunity involves a minor, we may require parent, guardian, or lawful representative involvement and may process information necessary to verify authority, protect the minor, satisfy production requirements, and comply with law.
11. Changes to This Policy
We may amend this policy at any time by publishing an updated version on this page. Changes apply from the effective date shown unless the updated policy states otherwise. Continued use of our website, accounts, forms, services, or communications after an update means you acknowledge the updated policy.
